Post-Divorce Family Law Issues

At the time the divorce decree is issued, the court will issue orders regarding such things as child custody, visitation and child support. Those orders are not set in stone however. When a significant change in circumstances occurs, you have the ability to ask the court to modify an order.

Modifying Child Support

The child support level is based on factors such as the incomes of the parents, the time the child spends with each parent and the child's special needs, among other factors. When one of these considerations change significantly and that fact can be demonstrated to the court to its satisfaction, it will issue a modification of the existing order.

In most cases involving a change in income — for example, as the result of a job layoff, promotion or disability — I can obtain a modification in an efficient and cost-effective manner. When a parent is self-employed or attempting to hide income, the task can become more challenging. As an experienced family law lawyer, I have a variety of tools at my disposal that I can use to determine the facts of the situation.

Child Custody and Visitation Modifications

Let's say a parent's job schedule changes from one shift to another. In this situation, I can often negotiate an acceptable custody or visitation arrangement that can be accepted by the court.
